I hereby certify that these drums are "EMPTY" as that term is defined in California hazardous waste regulations, CCR Section 66261.7, and that they have been properly prepared for transportation under the regulations of the U.S. Department of Transportation. 49 CFR 173.29.

************************************************************With regard to most drum residues, California’s CCR 66261.7 provides that "empty" drums. as defined, are exempt from hazardous waste regulation if they are managed in specific ways. A drum which previously held a hazardous material is California "empty" only if:

1. It meets the definition on an "empty container" in federal hazardous waste rules. 40 CFR 2C1.7. and2. It has been emptied by the generator as much as possible using methods commonly employed to remove material from drums. so that:

a. If the residue is pourable. no material can be poured or drained from the drum when the drum is held in any orientation (e.g.. tilted. inverted): or.

b. If the residue is not pourable. no material remains in the drum that feasibly can be removed by scraping or chipping.

To qualify for this exemption, drums must be labeled and packaged in accordance with applicable U.S. Department of Transportation requirements and shipped for scrap preparation (recycling), reconditioning or remanufacturing. If drums are not California "empty". or shipped for disposal. they must be managed as hazardous waste and are fully regulated by the Department of Toxic Substances Control as such.
