GLOSSARY

DEGREE OF DIFFICULTY:    The intent of the CAL/EPA in developing an empty container definition that imposes a greater degree of "emptying" difficulty that previously required is to provide incentive for the empty drum generator to choose the option of more complete drum emptying efforts in lieu of the cost and effort to manage and dispose of the drum as a hazardous waste.

CAL/EPA:    Department of Toxic Substances Control.

EMPTY:    That condition of a drum that meets the criteria described in Title 22 Section 66261.7 and once attained exempts the drum from being regulated as a hazardous waste.

GENERATOR:    The person who uses the contents of the container.

"NO MATERIAL CAN BE POURED OR DRAINED":   (See 66261.7(b)(2))  This expression has been interpreted to mean that regardless of the method of methocTh employed to empty a drum it is not exempt from regulation unless there are no substantive accumulations of residual materials on the internal surfaces of the sidewall, bottom or top of the drum which could have been readily removed by scraping. chipping, troweling. squeegeeing. etc..

NON—POURABLE:    That condition of residual material in a drum (e.g. pastes. gels. dehydrated and caked materials) such that were the drum to be inverted and titled. without closures in place. the residues would require means other than gravity to effect their removal or would require such a length of time to drain as not to be considered free flowing.

POURABLE:    That condition of residual material in a drum (e.g. liquids, powders, granulars) such that were the drum to be inverted and tilted, without closures in place, the residues would flow freely from the drum without assistance.
